Identifying Your Needs in Drafting Your Will

At my law firm, I spend time with my clients, assess their needs, and recommend the ideal type of will for their specific requirements and situations. I assist my clients in creating a variety of wills, including:

  • Simple Will: A simple will is just that — a simple document that provides for asset distribution from an estate that is not complicated. You select the beneficiaries when creating the will and it provides you control essentially over who gets what. A simple will also determines guardians to raise your children, if necessary.
  • Living Will: A living will is a will in name only. Also called an advance medical directive or directive to physicians and providers of medical services, the document is in force while you are still alive and does not designate assets or finances to any beneficiaries. The purpose of this will is to communicate your intentions to medical professionals and hospitals if you are terminally ill or cannot be restored to consciousness. It can specifically relate to life support or other artificial means to keep you alive.
  • Testamentary Trust Will: This type of will establishes one or multiple trusts for your assets following your death.
  • Pour-Over Will: For those who have established trusts prior to their death, a pour-over will is an effective form of asset protection. The pour-over will places assets in that trust or trusts.
